Please read these General Terms and Conditions carefully since they apply to customers who buy TRU PRO products via www.tieronesports.com, www.truproofficial.com ("USA") or its subdomains (https://europe.tieronesports.com, https://europe.truproofficial.com ("EUROPE"), https://global.tieronesports.com, https://global.truproofficial.com ("GLOBAL"), website ("Service," "Website" ) operated by TRU PRO (Tier One Sports, DBA) ("us," "we," or "our"). When ordering products from this Website, you automatically agree to these General Terms and Conditions. If you disagree with any part of the terms, you do not have permission to access the Service.
1. My Account
Orders can be placed on our Website without setting up a personal user account as long as you provide us with all required information during the order process. You also have the choice to set up your user account with a password. In that case, we will save your data in a database. Consequently, when you make another purchase from our Website, you will not have to enter your data again. Having access to the “My Account” section offers a thorough overview of your profile, past orders, orders that have not yet been delivered, and delivery and payment details. 3. Order process
To place an order on the Website, you must:

- By clicking “PLACE ORDER” to submit your order, you confirm that all the information you provided is correct.
You are making a binding offer with us when you make a purchase. This defines a contract with you. It is in TRU PRO's discretion to accept this offer by sending you an order confirmation via email or shipping the ordered products to the address specified in your order. TRU PRO will not be bound to accept orders but has the right at any time without notification to refuse them. A sales agreement is only considered to be concluded after you receive a.) an order confirmation via email or b.) after any part of the ordered products has been shipped to you. Our order confirmation will be sent to the email address you provided; a confirmation will contain a list of all appropriate order information and information on the payment method, customer service, warranty, data protection, and cancellation policy.

4. Prices & Shipping Charges
The prices displayed on our website (USA, GLOBAL) do not include sales or other taxes; prices shown on the Website for EUROPE do include sales taxes. Shipping or any other additional charges are not included in the price. Before you confirm and submit your order, all final costs will be calculated and displayed in the shopping cart. Orders from GLOBAL do not include customs-related charges that vary based on the country and are the customer's responsibility.
TRU PRO (USA and GLOBAL) ships using USPS and UPS, Monday-Friday (excluding official holidays); TRU PRO (EUROPE) ships using HERMES (https://myhermes.at). The shipping price will be calculated based on the size, weight, shopping cart total, and type of service you choose.
Any order placed by noon PST Monday - Friday (excluding public holidays) will usually ship the day of or the next business day. If you’ve placed an order after noon PST or on the weekend, your order will process within 1-2 business days.
We cannot ship orders to post office boxes and only ship to a physical address. We can also not accept orders where we cannot identify the individual delivery address.
On the product detail pages of the Website, you will find information on the availability of products sold on the Website. If TRU PRO notices that the products are no longer available during the order processing, we will inform you in an email.
You agree to be responsible for all costs resulting from an unsuccessful delivery if it is not possible to deliver the products to your delivery address (e.g., too large of a shipment for your location, refusal, etc.). The risk of loss of products will be passed to you upon delivery of the products to the address provided in your order.
6. Tracking Your Order
You can track your order using the tracking number provided in the shipping confirmation email. In addition, you may access the website of our shipping provider, which contains current information on your order and the delivery.
TRU PRO products must be paid in full before the orders will be delivered to you. We accept the following payment methods:

- JBC Cards
EUROPE additionally offers "Vorkassa" as a method of payment.
If for any reason, we cannot collect the amount payable for your order, your order will be canceled, and we will inform you accordingly.
You may return any product for a full refund within 30 days of receiving the product. Please ensure that any product you want to return is unopened and unused. You agree that it is the right of TRU PRO to decide if the product has been used.
If you wish to return Tennis Racket:
- New rackets can not show any scrapes; they must still have the original plastic on the handle and all original tags attached.
- Tennis bags must be returned in the original packaging and show no signs of use.
- Tennis strings and other accessories must be returned in the original packaging and unopened.

We do not refund shipping charges on any return from purchases US and GLOBAL that is not the consequence of an order mistake from us. Purchases from EUROPE will receive a refund for initial shipping charges.

Most TRU PRO rackets and bags are covered by a limited warranty for defective material for six months from the date of purchase of the original product when purchased on the Website. Repairing or replacing a warranted product does not extend the applicable warranty period. Proof of an invoice or receipt from TRU PRO is required. It is at our discretion to either repair or replacement the product. No warranty will be granted if a racket is improperly handled (strung incorrectly, added repairs, extreme signs of wear and tear, or beyond the warranty period.) Rackets must be returned strung. For replaceable parts like grips, grommets, or strings, we do not offer a warranty. Items that were purchased US or GLOBAL and are sent to the warranty department in San Diego, and purchases on EUROPE that are sent to Grengelbach, but upon inspection are considered not being covered by the TRU PRO warranty policy, will be returned to the customer. The customer will pay for return freight.

10. Contests, Giveaways and Sweepstakes
Any contests, giveaways, or sweepstakes (collectively, "Sweepstakes") made available through the Service may be governed by rules separate from these Terms & Conditions. Our liability will under no circumstances extend the actual amount paid by you for a faulty product, nor will we under any event be responsible for any loss of production, work, data, reputation, revenue, business or profit, costs of replacement of goods and services, special or punitive damages and losses, whether direct or indirect.
At our sole discretion, we reserve the right to modify or replace these Terms at any time. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. You are no longer authorized to use the Service if you do not agree to the new terms.

These General Terms & Conditions will be construed in conformity with the substantive laws of the state in the USA in which the order is submitted, without giving effect to its disagreements of laws principles. Any actions or claims related to these Terms and Conditions must be brought in the United States District Court for the District of California. By placing an order from TRU PRO's online shop, you agree to submit to the jurisdiction of said Court in all respects.
